1. Acceptance of Terms

By accessing or using the Pollinator Studio platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Pollinator Studio provides AI-powered podcast creation tools including script generation, text-to-speech audio production, automated newsroom briefings, and podcast distribution via RSS feeds. The Service is provided on a subscription basis with free and paid tiers.

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized use.

4. Content Ownership & Responsibility

You retain ownership of all content you upload or create using the Service. You are solely responsible for ensuring you have the necessary rights to use any source material (articles, text, images) you provide to the platform. AI-generated scripts and audio are derivative works based on your inputs — you are responsible for reviewing and approving all generated content before publication.

The Service generates summaries and analysis of source material (transformative use). It does not republish source content verbatim. However, you should consult legal counsel regarding fair use in your jurisdiction before publishing content derived from third-party sources.

5. Acceptable Use

You agree not to:

• Use the Service to generate illegal, defamatory, or harmful content
• Misrepresent AI-generated content as human-created without disclosure
• Attempt to circumvent usage limits or billing controls
• Use the Service to spam, harass, or impersonate others
• Reverse-engineer, scrape, or programmatically access the Service outside of provided APIs

6. Billing & Subscriptions

Paid plans are billed monthly or annually via Stripe. Upgrades take effect immediately with prorated credits for unused time. Downgrades take effect at the end of the current billing period. Unused minutes roll over for up to 2 billing periods. All prices are in USD. Refunds are handled on a case-by-case basis — contact support.

7. Data Storage & Retention

Free-tier audio files are retained for 7 days. Paid plans include extended retention as specified in the plan details. We store your data on enterprise cloud infrastructure in the United States. You may request deletion of your data by contacting support.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your account for violations of these terms. You may cancel your subscription at any time through the billing portal. Upon termination, your data will be retained for 30 days before permanent deletion.

10. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or in-app notification. Continued use after changes constitutes acceptance.
